• On Aug. 26, an arrest warrant was issued for Jonavon Loney, 23, Appleton City, charging him with a class D felony of property damage-first degree. The charge stems from an incident on Aug. 19 involving the Appleton City Police Department. St. Clair County Sheriffs Office: Warrant Arrest

Ronald Noble

• On Aug. 28, Ronald Noble, 45, Independence, was arrested on a St. Clair County warrant for failing to appear in court on an original charge of non support, a class A misdemeanor. Bond was set at $1,500 cash only. The warrant was issued on May 12. A court date of Sept. 5 was issued.

The National Weather Service in Pleasant Hill, Missouri has issued a Severe Thunderstorm Watch for Bates County until 4 a.m.Monday morning.

Four Nevada teenagers hurt in early morning crash

Four Nevada teenagers were hurt early today in a one-vehicle crash on Jayhawker Road, four miles North of Nevada in rural Vernon County. 

Missouri Highway Patrol trooper Art Torbeck says the accident happened about 4:00 a.m. when an East-bound 1991 Chevy Blazer, driven by 22-year-old Noah Colopy of Nevada, drove off the left side of the road and overturned. Taken to Nevada Regional Medical Center with minor injuries were four passengers: 14-year-old Abbigail Elliott, 15-year-old Dakota Miller, 17-year-old Steven Pettibone and 14-year-old Haley Toland. Colopy was not hurt.


The vehicle was totaled and removed from the scene by the owner, No one in the vehicle was wearing a seatbelt.

EMPHASIS: Patrol Provides Synopsis Of Some New Laws, Which Went Into Effect August 28, 2014

The Missouri General Assembly recently enacted new legislation. Governor Jay Nixon has signed the legislation into law. Some of the laws contained an emergency clause, which went into effect upon the signing; others go into effect August 28, 2014. The Patrol wishes to make the public aware of several of these new laws or changes to increase public awareness and education. • HOUSE BILLS

• HB 1190 – TRANSPORTATION

The bill requires the Department of Transportation to issue emergency utility response permits that allow motor carriers to transport equipment and the infrastructure necessary for repair work immediately following a disaster where utility service has been disrupted. Under exigent circumstances, verbal approval of the operation may be made by the motor carrier compliance supervisor or other designated motor carrier services representative. The motor carriers may operate on state highways and roads at any time on any day to assist utility companies granted a permit. (Section 304.180 RSMo.)

• HB 1231 – JUDICIAL PROCEDURES

DRIVER'S AND NON-DRIVER'S LICENSES (Sections 302.065 and 302.067 RSMo.)
The bill specifies that a person who has presented documents to obtain a driver's license, nondriver's license, or instruction permit must not be required to present the documents again to obtain a renewal or replacement except for documents that demonstrate lawful presence of an applicant who is not a citizen, if it is reasonably believed by the Department of Revenue that the prior license may have been issued as a result of a fraudulent act of the applicant, or the applicant is applying for or renewing a commercial driver's license or instruction permit.

DISARMING A POLICE OFFICER (Section 575.153)
The bill includes removing any less lethal weapon, to include blunt impact, chemical, or conducted energy devices, used in the performance of his or her official duties to the crime of disarming a peace officer.

HB 1372 – FUNERAL PROTESTS

This bill specifies that a person commits the offense of unlawful funeral protest, a class B misdemeanor, if he or she pickets or engages in other protest activities within 300 feet of a residence, cemetery, funeral home, church, synagogue, or other establishment during or within one hour before or one hour after the conducting of any funeral or burial service at that place. These provisions do not apply to a funeral procession while it is in transit beyond the 300-foot zone. The offense is a class A misdemeanor if the offense is committed by a person who has previously been found guilty of a violation of these provisions. The bill repeals Sections 578.501 through 578.503, RSMo., known as "Spc. Edward Lee Myers' Law," regarding unlawful picketing or other protest activities at a location at which a funeral is held. (This law also appears as part of HB 1231.)

• HB 1665 – ADMINISTRATION OF JUSTICE

This bill changes the laws regarding the administration of justice.

CRIMINAL RECORD INFORMATION (Section 407.1150 RSMo.)
The bill specifies that it must be unlawful for any person engaged in publishing or disseminating criminal record information through a print or electronic medium to solicit or accept a fee or other consideration from the subject individual to remove or correct criminal record information. A person who knowingly and willfully violates these provisions will be guilty of a class A misdemeanor. Any individual who suffers a loss or harm as a result of a violation of these provisions may be awarded an amount equal to $10,000 or actual and punitive damages, whichever is greater, and reasonable attorney fees, court costs, and any other remedies provided by law. Humiliation or embarrassment must be adequate to show that the plaintiff has incurred damages; however, no physical manifestation of either humiliation or embarrassment is necessary for damages to be shown.

POWER TO ARREST (Section 544.216 RSMo.)
Currently, a law enforcement officer may arrest on view, and without a warrant, any person the officer sees violating or who the officer has reasonable grounds to believe has violated any law of this state or any ordinance over which the officer has jurisdiction. The bill clarifies that a law enforcement officer may only arrest a person without a warrant for a violation of any ordinance or law over which the officer has jurisdiction.

EXPUNGEMENT OF ARREST RECORDS (Sections 610.120 and 610.122 RSMo.)
The bill allows an individual's record of arrest to be expunged under Section 43.503 RSMo. if the court determines the individual was arrested for, or was subsequently charged with, a misdemeanor offense under Chapter 303 RSMo. or any moving violation under Section 302.010 RSMo., except for any intoxication related traffic offense and:

(1) Each offense or violation related to the arrest was subsequently nolle prossed or dismissed or the accused was found not guilty of each offense or violation; and
(2) The person does not have a commercial driver's license and was not operating a commercial motor vehicle at the time of the arrest.

A record of arrest must only be eligible for expungement if the subject of the arrest has no prior or subsequent misdemeanor or felony convictions and no civil action is pending relating to the arrest or the records sought to be expunged.

• HB 2163 – COMMERCIAL ZONE IN COLUMBIA

This bill establishes a commercial zone in the city of Columbia. A vehicle operating within the zone cannot exceed 15 feet in height or have a greater weight than 22,400 pounds on one axle. The commercial zone extends north from the city limits along U.S. Highway 63 for eight miles and east from the city limits along State Route WW to the intersection of State Route J and continues south on State Route J for four miles. (Section 301.190 RSMo.)

• HB 2238– HEMP

This bill changes the laws regarding hemp. In part, the bill:
(1) Requires the Department of Health and Senior Services to issue a hemp extract registration card to a Missouri resident who suffers from intractable epilepsy and may benefit from treatment with hemp extract. The department may issue a hemp extract registration card to a parent of a minor who meets specified criteria;
(2) Specifies that an individual in possession of hemp extract is not in violation of possession of a controlled substance if the individual possesses the hemp extract only to treat intractable epilepsy; has a certificate of analysis that contains specific information about the extract; and has a current registration card;
(3) Allows an individual who has been issued a valid hemp extract registration card to possess up to 20 ounces of hemp extract and may obtain a medical waiver to exceed that limit.

This bill contains an emergency clause and went into effect immediately upon its signing on July 14, 2014.

• SENATE BILLS

• SB 745 – CONCEALED CARRY PERMITS; LAW ENFORCMENT OFFICERS

POWER TO ARREST - Section 544.216 RSMo.
Under current law, a law enforcement officer may arrest on view and without a warrant any person the officer sees violating, or who the officer has reasonable grounds to believe has violated, any law of this state, or any ordinance over which the officer has jurisdiction.
SPECIAL PROSECUTOR EXEMPTION - Section 571.030 RSMo.
This act exempts special prosecutors in the unlawful use of weapons law. 
 

• CONCEALED CARRY PERMITS - Sections 571.101, 571.104, 571.111 & 650.350 RSMo.

The size of the concealed carry permit is changed under this act.
This act requires the Missouri Sheriff Methamphetamine Relief Task force, or MoSMART, to provide grants to sheriffs and any designee that is created to support sheriffs in the creation and maintenance of a statewide concealed carry permit system that is accessible to sheriffs and law enforcement agencies. Current law requires sheriffs to report certain information regarding concealed carry permit holders to the Missouri Uniform Law Enforcement System or MULES. This act requires such information to be reported to the new concealed carry permit system. 
 
Under this act, the official to whom a concealed carry endorsement or permit was surrendered when suspended or revoked must change the status of the endorsement or permit in the concealed carry system. 
 
This act repeals a provision requiring a sheriff to notify a person when such person's permit or endorsement is expired and canceled. 
 
Procedures for when a permit holder changes his or her address are modified.
Current law requires automatic invalidation of a permit or endorsement after 30 days if a permit holder has changed his or her name or address and not notified the sheriff. Under this act, the permit or endorsement is automatically invalid after 180 days. This act requires a person to notify the sheriff of a name or address change within 30 days and allows the sheriff to impose a late penalty of $10 per month for each month the person fails to notify the sheriff.

• SB 785 – BOATING SAFETY

Currently, nonresidents are permitted to obtain a seven day temporary boating safety identification card one time. This act expands the one time opportunity to include Missouri residents. (Section 306.127 RSMo.)

Appleton City Fair to be on public TV

 

On Tuesday, Sept. 2 at 7:00pm, and again on Thursday and Saturday, Kansas City Channel 19 will feature a story by the KC Star writer Charles Gusewelle.

 

Mr. Gusewelle's wife was a winner of the Appleton City Stout Prize Baby Show held yearly at the AC Fair, and this will be a feature of the segment, as well as some footage of the 2014 AC Fair. It started in 1903, so many babies have entered the show

KRISTY SMITH is recognized as the Bates County Memorial Hospital Employee of the Month for September, 2014. Kristy has been employed at BCMH since January, 1997. Kristy is the Activities Director of the Nursing Department, as well as working as a Certified Nursing Assistant. 

Kristy has demonstrated many times over her dedication to the hospital. She is flexible in changing her schedule to meet our needs, whether it is to fill in during vacations, illness or high patient census. Her loyalty and support is greatly appreciated. Kristy is an asset to the hospital and the patients we serve.

REMINDER: Circus coming to town

The Culpepper and Merriweather Circus will be in Butler on Sunday, September 7th with two scheduled performances at 2:00 and 4:30pm. Skeeter, the Culpepper and Merriweather Circus Advance Clown will be in Butler about two weeks before Circus Day.

Arrive early September 7th and watch the raising of the Big Top from 9:30 – 10am as well as animals unloaded and rigging prepared for later performances. A free tour will be offered afterward. The presentation will include a walking tour of the circus grounds where you will learn interesting facts about performers, the history of the show and the care of the circus animals.

The Midway will open at 1pm with pony rides, a 22-foot inflatable slide and a carousel moon bounce. They will have classic concession food on sale before the 90-minute performances which will include a trapeze, unicycles, contortion, tight wire, clown, performing animals and much more.

• Cass County

I-49: Slope slide repair will close the right lane of southbound I-49 just south of 155^th Street from 8 p.m. Tuesday, Sept. 2, to 4 a.m. Wednesday, Sept. 3, and from 8 p.m. Wednesday to 4 a.m. Thursday, Sept. 4.

Route 58: Sidewalk, curb and gutter work will close the right lane at times on eastbound Route 58 between I-49 and N. Clint Drive from 7 a.m. to 5 p.m. daily from Thursday, Aug. 21, through Sept. 12.

Route 58: Sidewalk, curb and gutter work will close a lane at times on westbound Route 58 between I-49 and N. Clint Drive from 7 a.m. to 5 p.m. daily through Aug. 31.

I-49: Roadside work will restrict southbound I-49 between 155^th Street and 163^rd Street from 9 a.m. to 3 p.m. through October 1.

Obituary - Barbara Louise Boyles

Barbara Louise Boyles, age 75 of Archie, Missouri died Wednesday, August 27, 2014 at Menorah Medical Center in Overland Park, Kansas. She was born October 9, 1938 to Howard Payton and Aline Elizabeth Lord Carson in Denver, Colorado.

Barbara is survived by two sons, Johnnie Lee Boyles and wife Yvette of Adrian, Missouri and Larry Ray Boyles and wife Sherry of Archie, Missouri; one brother, Gary Carson and wife Kay of Lacey, Washington; three halfbrothers, Jim Barker, Joe Barker and Terry Barker; and seven grandchildren, Amber, Brandon, Josh, Caitlyn, Larry Lee, Kevin and Missy; and numerous great-grandchildren. She was preceded in death by her parents; husband, Clarence “Roy” Boyles; one brother, Larry Carson; and two infant children.

BUTLER, MO ― Kevin and Mary Fischer of Bates County were among the 110 families honored during the Missouri State Fair’s Farm Family Day on August 11, 2014. 

The Fischers were selected as the Bates County Missouri State Fair Farm Family by the Bates County Extension Council and local Farm Bureau. 

Each year, the fair sets aside a day to recognize farm families from across the state who are active in their community, involved in agriculture, and participate in local outreach and extension programs such as 4-H and FFA. 

The annual event was sponsored by the Missouri Department of Agriculture, the Missouri Farm Bureau, the Missouri State Fair, the University of Missouri College of Agriculture, Food and Natural Resources, and University of Missouri Extension.

Obituary - Billee Rae (West) Lee

Billee Rae (West) Lee, LaCygne, Kansas and a native of El Dorado Springs, Mo. and a 1948 graduate of El Dorado Springs High School, passed away today at the age of 84. Arrangements are under direction of the Schneider Funeral Home-Chapel at LaCygne and services are planned at 11:00 a,m. Saturday, August 30, at the LaCygne Christian Church with burial to follow in the Oak Lawn Cemetery. The family receives friends between five and seven o'clock Friday evenng at the funeral home-chapel in LaCygne. Memorials to the LaCygne Christian Church or the Alzheimer's Foundation are suggested.

Medical Condition Causes Auto Accident in Cass County

Around 11:55am this morning the Missouri State Highway Patrol along with The Cass County Sheriffs Office and Pleasant Hill EMS all responded to a 1 vehicle accident on Southbound Missouri 7 Highway and Elliot Road in rural Cass County.

The accident occurred when the 1999 Isuzu was Southbound on Mo-7 Highway when the driver 78 year old Harry E. Avery of Harrisonville, Missouri had a medical condition which caused him to lose control and travel off the right side of the roadway. The vehicle struck a ditch, pole and tree before coming to rest.

Mr. Avery was transported by EMS to Centerpoint Hospital in Pleasant Hill with minor injuries, The vehicle received moderate damage and was towed from the scene by Johnson Tow.

Carla J. (Tordsen) Lawrence, 71 of Butler, Missouri passed away August 26, 2014 in Kansas City, Missouri. She was born May 22, 1943 in Round Lake, Minnesota, daughter of Carl and Delores (Gingerich) Tordsen.

Carla was preceded in death by her parents and one brother, Ronald Tordsen. She is survived by her husband, Dean Lawrence of Butler; daughter Patricia Rea of China; son Larry Lawrence of Springfield, Missouri; daughter Lynne Blevins and husband Dewayne of Sioux Falls, S.D., son Brian Lawrence and wife Crystal of Butler, and daughter Kathy Henderson and husband Allen of Butler. She also leaves behind a sister, Sandra Hardy of San Diego, California and a brother, Craig Tordsen, also of California. Carla is also survived by 32 grandchildren.

Leister named Senior Herd Manager at Oklahoma State University

Jeremy Leister

Recently, Jeremy Leister, son of Jeff and Beth Leister of Amsterdam, Mo. was promoted to the position of Senior Herd Manager at Oklahoma State University in Stillwater, OK. He had previously held the position of Herd Manager, with Oklahoma State University, since 2011. 

Jeremy is a 2007 graduate of Miami R-1 High School. A member of National Honor Society, he was the class Salutatorian as well as class Vice President. He also served as the Miami FFA Chapter President his Senior year. A 4 year-two sport letter winner, in basketball and football. He was selected to the ALL-District team in football his Senior season.

After Miami, Jeremy won a scholarship to Hutchinson Community College in Hutchinson KS. While at Hutchinson, Jeremy competed in Livestock Judging for 2 years. He earned his Associates Degree at Hutchinson Community College and went on to Oklahoma State University on yet another scholarship. While at OSU Jeremy continued to compete in Livestock Judging.  Jeremy was an integral member of the 2010 National Championship Livestock Judging team.

Upon completion of his degree at Oklahoma State, he was hired as one of the herd managers in the beef operation for the university. He was in charge of one of the herds, responsible for the daily upkeep and production of the herd.

As Senior Herd Manager, Leister will be in charge of all the universities beef herds as well as all aspects of the production the entire university beef operation. In addition he will also be managing all of the show cattle the university raises and be involved with showing at the various national livestock shows across the country.

Jeremy is excited to tackle this new challenge and looks at it as an incredible opportunity

Funeral services for Dr. C.W. “Doc” Marsh will be 10:30 AM Saturday, August 30, 2014 at the Drexel First Baptist Church in Drexel, Missouri with Rev. Mike Cooper officiating. Visitation Friday evening, 6-8 PM at Mullinax Funeral Home – Drexel Chapel in Drexel, Missouri. Burial will follow services in Sharon Cemetery near Drexel. Dr. Charles Woodard “Doc” Marsh, 92 of Drexel, Missouri passed away August 26, 2014 at his home in Drexel. Doc was born June 25, 1922 in Cicero, Indiana, son of Charles William and Olive Ruth (Woodard) Marsh.

Doc was preceded in death by his parents. He is survived by his wife of 69 years, Rose Marsh of Drexel; daughter Donna Ziegler and husband Joe of Drexel; son Charles William “Bill” Marsh of Shawnee, Kansas; daughter Patricia Deel and husband Daryl of Louisburg, Kansas; and daughter Judy Still and husband David of Drexel; as well as 10 grandchildren and 16 great-grandchildren. Doc also leaves behind his special Angels on Earth, Angie Jenkins, Delores Halbin and Stephanie Cravens.
